These Terms of Service ("Terms") govern your access to and use of https://aevumo.com (the "Site") and your purchase of products from Aevumo. The Site is operated by Aevum Labs INC ("Aevumo," "we," "us," or "our"). By visiting the Site, placing an order, or otherwise using our services, you agree to these Terms and to the policies referenced in them.
If you do not agree to these Terms, do not use the Site or purchase our products.
1. Eligibility and Account Information
You must be legally capable of entering into a binding contract in your jurisdiction to make a purchase. If you create an account or submit information to us, you are responsible for providing accurate, current, and complete information and for safeguarding your account credentials.
You may not use our products, Site, or services for any unlawful or unauthorized purpose.
2. Products and Handmade Variations
We make reasonable efforts to describe and display our products accurately. Screens, lighting, photography, and natural materials can affect how colors, textures, patterns, and dimensions appear. Because many Aevumo pieces are handcrafted or prepared in small batches, minor variations may occur from one piece to another. These characteristics are part of handmade production and are not defects, provided the item remains materially consistent with its product description.
Product availability is not guaranteed. We may limit quantities, discontinue products, or correct errors in descriptions, pricing, or availability.
Product descriptions and content are provided for general informational purposes. Any references to traditions, symbolism, wellness, energy, spirituality, or similar subjects describe cultural context or personal practices and are not medical advice, diagnosis, treatment, or a promise of any particular outcome.
3. Orders and Acceptance
Your order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We may decline or cancel an order for legitimate reasons, including suspected fraud, payment problems, pricing or inventory errors, shipping restrictions, or product unavailability. If we cancel after payment has been collected, we will refund the affected amount to the original payment method.
You are responsible for reviewing your order, contact information, and shipping address before submitting payment.
4. Prices, Payment, and Taxes
Prices are displayed in the currency indicated on the Site and may change without notice. The price charged is the price shown when you submit the order, except in the case of an obvious error. Shipping charges, taxes, duties, and other applicable costs will be displayed at checkout when they can be calculated or otherwise handled as described in our Shipping Policy.
You represent that you are authorized to use the payment method submitted with your order. Payment processing may be performed by third-party providers and is subject to their terms and privacy practices.
5. Preparation, Shipping, and Delivery
Because our products are handcrafted or prepared in small batches, orders normally require 3–5 business days of preparation before shipment. Carrier transit time is additional. Shipping options, estimates, tracking, international charges, and delivery issues are governed by our Shipping Policy.
Delivery dates are estimates unless we expressly state that a service is guaranteed. Responsibility for loss or damage during delivery will be determined according to applicable law and the circumstances of the shipment.
6. Returns, Exchanges, and Refunds
Returns, exchanges, cancellations, damaged items, and refunds are governed by our Return & Exchange Policy, which forms part of these Terms. Nothing in these Terms limits non-waivable consumer rights.
7. Intellectual Property
The Site and its content—including text, photographs, graphics, logos, product names, designs, layout, and other materials—are owned by or licensed to Aevumo and are protected by applicable intellectual-property laws. You may use the Site for personal, non-commercial shopping purposes. You may not copy, reproduce, distribute, modify, publish, sell, scrape, or commercially exploit Site content without our prior written permission, except as allowed by law.
8. Reviews and Other User Content
If you submit a review, image, comment, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not infringe another person's rights. You grant Aevumo a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content in connection with our business and marketing, subject to applicable law and our Privacy Policy.
We may remove user content that is unlawful, misleading, abusive, infringing, or otherwise inappropriate, but we are not obligated to monitor all submissions.
9. Prohibited Conduct
You must not:
- Violate any applicable law or another person's rights
- Submit false, fraudulent, malicious, or misleading information
- Introduce malware or interfere with the security or operation of the Site
- Attempt unauthorized access to the Site, accounts, systems, or data
- Use automated means to scrape, harvest, or overload the Site without permission; or
- Use the Site or its content to infringe intellectual-property or privacy rights.
We may suspend or terminate access for conduct that violates these Terms.
10. Third-Party Services and Links
The Site may use or link to services operated by third parties, including Shopify, payment processors, carriers, analytics providers, and social platforms. We are not responsible for third-party websites, content, availability, or independent practices. Your use of a third-party service may be governed by that party's terms and policies.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and its content are provided on an "as available" basis. We do not warrant that access will always be uninterrupted, secure, or error-free. Products are subject to any express descriptions or warranties provided on the applicable product page and to rights that cannot lawfully be excluded.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
12. Limitation of Liability
To the fullest extent permitted by law, Aevumo and Aevum Labs INC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or purchase or use of products. Where liability cannot be excluded, our aggregate liability will be limited to the amount you paid for the product or service giving rise to the claim, unless applicable law requires a different remedy.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limits mandatory consumer rights.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Aevumo, Aevum Labs INC, and their officers, employees, service providers, and agents from third-party claims arising from your unlawful misuse of the Site, your violation of these Terms, or your infringement of another person's rights.
14. Privacy
Our collection and use of personal information are governed by our Privacy Policy. Shopify and other service providers may also process information under their own privacy terms.
15. Changes to the Site or Terms
We may update the Site, our services, or these Terms from time to time. The effective date at the top identifies the latest version. Changes apply prospectively when posted unless a different date is stated or applicable law requires otherwise. Your continued use of the Site after an update means you accept the revised Terms.
16. Termination
We may suspend or terminate your access to the Site if you materially violate these Terms or use the Site in a way that threatens its security, integrity, or lawful operation. Provisions that by their nature should survive termination will remain effective.
17. Severability and No Waiver
If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver of that right.
18. Governing Law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles. This choice does not deprive consumers of protections that cannot be waived under the law of their place of residence.
19. Entire Agreement
These Terms and the policies posted on the Site constitute the agreement between you and Aevumo concerning your use of the Site and purchases from us, except for any additional terms expressly agreed in writing.
